The Punishment Should Fit the Crime
The unthinkable has now happened!!
During what appears to be another home invasion, two elderly people have been murdered.
The issue of home invasions legislation has been delayed and politicized to the point that the person or persons that committed this crime face a burglary in the 1st degree charge with a mandatory sentence of only TWO YEARS!!! One must ask if this is Justice. Yes, there were other crimes that were committed that could be prosecuted, but this criminal will only have to face ONE charge that would put him away for LIFE.
There are two bills pending. One that calls for 15 years to life as the penalty for the crime of home invasion and one that calls for 6 years and if the victims are 62 years of age or older, 8 years. Which is more appropriate for this crime?
It is a shame and an absolute embarrassment that politics got in the way of common sense. It is amazing that when we have an issue such as “Bath Salts” that emergencylegislation can be introduced, passed, and signed in to law in very short order, but legislation for this crime with such vicious proportions has dragged out
since January, when I introduced Senate Bill 161.
In this game of political football, again the victims lose, the bad guys win, and the one party rule gets its way. The victims and those of us that will become the next victims must hold those that are soft on crime
accountable!
Being a victim of a violent crime is one thing, but being victimized by the game of “Political Football” should, in itself, be criminal.

URGENT UPDATE RE: SB 161 & HB 277
The Two Sisters from Sussex were traveling this week, attending meetings and we have a much clearer picture to present to our fellow Delawareans regarding SB 161 and HB 277. Here in essence, is what has taken place.
Senator Dave Lawson, whom is concerned, with the rise of home invasion taking place in the State of Delaware creates SB 161. This 3 page bill, will implement a tough penalty for criminals who enact a home invasion upon a Delaware resident and make it a Class A Felony; first offense, 15 years in prison; second offense, life in prison. SB 161 has support among the Senators; however the Judiciary Committee, headed by Senator Patricia Blevins will not introduce the bill to the Senate floor.
This allows the Attorney General, Beau Biden to fashion a bill regarding home invasions that is nothing like SB 161. It is another example of the Attorney General’s lax attitude toward crime. HB 277, a 14 page plus bill, is written by the Attorney General’s office and creates a home invasion as a Class B Felony, with no harsh punishment.
This bill is given to Representative Heffernan to introduce into the Legislation, as according to the powers in control, Rep. Heffernan apparently needed a credential to run on for re-election. HB 277 was introduced into the House of Representatives this week, and is expected to be voted on within a couple of days. Upon passing, which it is expected to do because of the party control in the House of Representatives; it will then go onto the Senate to be voted on. All of this takes place in a matter of a few weeks while Senator Blevins sits on Senator Lawson’s real home invasion bill, SB 161, since January 11, 2012, i.e., 3½ months.
Here is the Real Problem:
Senator Lawson’s bill SB 161 was stolen, watered down, rewritten by the Attorney General, Beau Biden, and given to Representative Heffernan as something to use in her re-election campaign.
HB 277 is a "Fake”.
HB 277 is a home invasion bill that does nothing to protect the citizens, in fact, we think Delaware citizens, are less protected, with this bill, in its current form, passing into law. This is because HB 277 will make a home invasion a Class B Felony, no matter what crime occurs at the scene.
A criminal who commits rape or murder upon someone during a home invasion could possibly only have to serve 4 years in prison.
This would explain why the Attorney General, Beau Biden wrote and fashioned HB 277.
Let’s remember, Department of Corrections Commissioner Carl Danberg is on record saying the only way to see significant saving from justice system reform, is if the prison population drops to such an extent that allows one of its facilities to close. This is another example of not wanting criminals in the prison system for
any amount of time.
During a meeting, we attended Thursday afternoon, legislators admitted this was nothing but politics and they were not proud of what was going on.
Some Legislators, did state they would try to have an amendment put on to HB 277 making it a Class A Felony, however, that is only tackling a portion of the problem with HB 277.
Fellow Delawareans, we must act today and call Senator Patricia Blevins office @ 302-744-4133, insisting that she quit sitting on SB 161 and introduce the bill to the Senate floor so it may be voted on before HB 277 is rammed upon Delawareans.

Crime is a major problem in the State of Delaware, in 2011, Delaware ranked fourth in the nation for violent crime (for crime statistics in Delaware read the entry below this posting). One segment of crime that is on the rise is home invasions. Home invasion is the act of illegally entering a private and occupied dwelling with violent intent for the purpose of committing a crime against the occupants such as robbery, assault, rape, murder, or kidnapping. Home invasion is generally an unauthorized and forceful entry into a dwelling. In some jurisdictions there is a defined crime of home invasion; in others there is no crime defined as home invasion, but events that accompany the invasion are criminal(http://en.wikipedia.org/wiki/Home_invasion). Last year, Delaware reported 48 home invasions, a disturbing trend that has prompted state legislators to respond and give a definition to home invasion in the State of Delaware.
January 2012, Senator Dave Lawson (R-Marydel), the primary sponsor, filed Senate Bill 161. SB161 seeks to create the crime of "home invasion" and designate it as a Class A felony, carrying a minimum sentence of 15 years in prison. A person convicted of the crime for a second time would receive a mandatory life sentence without the possibility of parole. Under the Senate measure, a perpetrator could only be found guilty of home invasion if he or she knowingly entered an occupied dwelling, armed with a deadly weapon and also committed an additional crime of robbery, assault, rape, kidnapping, manslaughter or murder.
Representative Lincoln Willis (R-Clayton), additional sponsor said, “I believe this crime is among the worst that can be committed because it not only robs the victim of their property; it strips them of their sense of
security. SB 161 treats home invasion as the heinous act it is and punishes the people that commit it accordingly."
SB 161, currently pending action in the Senate Judiciary Committee, has received the support of Kent County Levy Court, which in February, 2012, passed Resolution 3266 endorsing it (De House of Representative e-newsletter).

March 2012, a rival bill was unveiled at a press conference staged by State Representative Debra Heffernan (D-Brandywine Hundred South) and State Attorney General Beau Biden from which Republican legislators were excluded. The bill has support from the Attorney General's Office and the Department of Safety and Homeland Security, Heffernan said (http://www.wboc.com/story/17117459/del-lawmakers-seek-tougher-penalties-for-home-invasions?client). “This bill sends a strong message and promises the certainty of a long prison sentence to criminals who terrorize Delawareans in their homes,” Attorney General Biden said. “The tough penalties in this legislation reflect how seriously we take these crimes and will make offenders think twice before they threaten the peace and security of our families.” (http://www.newarkpostonline.com/news/article_0638fea0-6967-11e1-947e-0019bb2963f4.html).
The proposed penalties in the House measure, however, are considerably lighter than those contained in Senate Bill 161. The House bill designates home invasion as a Class B felony, carrying a minimum mandatory sentence for a first offense of four years in prison. A second offense, occurring within five years of the first, would carry six years of mandated jail time. Those penalties would increase marginally if the victim is 62 years of age or older. In that instance, a first time offender would face a minimum of six years behind bars with a second violation carrying an eight year minimum sentence.
"Every citizen deserves to feel safe and secure in their home and it's my hope that this will help accomplish that by treating this crime with the seriousness it deserves," said Senator Harris B. McDowell III (D-Wilmington North) co-sponsor of house bill. "Home invaders not only take property, they terrorize residents and neighbors who wonder if they'll be next."
Senator Dave Lawson, the primary sponsor of Senate Bill 161, said that while he agrees with Senator McDowell's sentiments, he found his approach severely lacking. "What Representative Heffernan and Senator McDowell are proposing is a pale half-measure. Delaware has a 70 percent recidivism rate. The House bill would just give criminals with a demonstrated willingness and propensity to commit this crime a greater opportunity to do it again."
Representative Lincoln Willis (R-Clayton), additional sponsor of SB 161, agreed. "This House bill is 'home invasion lite,'" he said. "Not only is this legislation late to the party, it proposes dealing with home invasion as if it is just a more severe form of burglary. It isn't."
"This is a crime unlike any other," Senator Lawson said. "Senator McDowell was right when he said: 'Every citizen deserves to feel safe and secure in their home.' But the bill he's supporting carries a minimum sentence of just four years. How secure are these victims supposed to feel knowing their assailant may be out of prison in as little as four years? We need to establish a powerful new deterrent and make the punishment fit the extreme nature of the crime. The House bill does not do that. Senate Bill 161 does." (DE

In 2009, Delaware’s violent crime rate was higher than the national average by over 59% and Delaware’s property crime rate was higher than the national average by over 24% (http://www.cityrating.com/crime-statistics/delaware/). In Delaware your chances of being a victim of violent crime is 1 out of 161, while your chances of being a victim of property crime are 1 out of 29. Most Americans do not realize there is a Federal Agenda to release prisoners throughout the country. Delaware’s Governor Jack Markell has aligned himself with the Federal Agenda. In 2011, he initiated Executive Order 27 (http://governor.delaware.gov/orders/exec_order_27.shtml) which created the Delaware Justice Reinvestment Initiative Task Force. This Task Force has requested the Vera Institute of Justice for assistance in reducing state correctional spending. Without all the facts, this may seem like a good idea as the Department Of Correction’s (DOC) budget is over $250 million annually. In 2007, Delaware ranked 2nd in the nation for state correctional spending per capita, however the following year Delaware ranked only 19th nationally in incarceration (http://www.taxpayersnetwork.org/Downloads/50%20state%202010.pdf?_qsbh=H6NQLuHC_Pau!ZHBK!iNR). Why is Delaware’s spending as if its incarceration rate is second in the nation, when it certainly is not? Could it be a mismanagement of funds?
In a February 2012 interview with WBOC-TV, DOC Commissioner, Danberg notes that roughly two-thirds of the department’s budget is for personnel costs (http://www.wboc.com/story/16924309/del-corrections-commissioner-discusses-budget?client). Thanks to the Caesar Rodney Institute and Transparent Delaware, we are able to take a closer look at these figures. In 2010, 50% of DOC employees received overtime pay. Within that number, 59 employees collected overtime that exceeded 100% of their salary plus considerable “other” pay. Another 85 employees earned overtime and “other”pay equal to 75% to 99% of their salaries, 240 employees received 50% to 75%, 728 employees received 25% to 74% and 889 received up to 24%. You won’t want to miss reading the following document showing the breakdown of salary, overtime and “other” pay of DOC’s hardest working employees (http://transparentdelaware.org/fiscal-prisoners-120220/) and the interesting letter the Caesar Rodney Institute wrote to Danberg asking him 32 questions that he has yet to answer (http://www.caesarrodney.org/pdfs/DanbergLetter.pdf).
Also in the 2012 interview, Danberg said the only way to see significant saving from justice system reform, is if the prison population drops to such an extent that allows one of its facilities to close. Delaware, are you beginning to see the alignment with the Federal Agenda? Remember, Delaware currently ranks 4th in the nation in Violent Crime with a recidivism rate over 76%. Do you believe this downsizing will be in the best interest of the safety of Delaware’s citizens?
To give further evidence of the Federal Agenda it is beneficial for one to know that U.S. Attorney General, Eric Holder, spoke in 2009, at the Vera’s Institute of Justice’s Annual address (http://www.justice.gov/ag/speeches/2009/ag-speech-090709.html). Again, further evidence arises when one knows that Delaware’s Justice Reinvestment Initiative Task Force is funded by the U.S. Department of Justice’s Bureau of Justice Assistance through its own Justice Reinvestment Initiative (http://www.vera.org/project/justice-reinvestment-initiative/delaware). Again, this Task Force has requested assistance from the Vera Institute of Justice, which is financially supported by the Open Society Institute (renamed in 2011 to the Open Society Foundations)(http://en.wikipedia.org/wiki/Vera_Institute_of_Justice). The Open Society Institute was founded by billionaire hedge-fund financier, George Soros, in an effort to shape public policy (http://en.wikipedia.org/wiki/Open_Society_Institute). For those of you not familiar with Soros, he has made a career of supporting extreme liberalism and socialism throughout the U.S. and the world at large. In a February 2012 interview with WBOC-TV, DOC Commissioner, Danberg notes that roughly two-thirds of the department’s budget is for personnel costs (http://www.wboc.com/story/16924309/del-corrections-commissioner-discusses-budget?client). Thanks to the Caesar Rodney Institute and Transparent Delaware, we are able to take a closer look at these figures. In 2010, 50% of DOC employees received overtime pay. Within that number, 59 employees collected overtime that exceeded 100% of their salary plus considerable “other” pay. Another 85 employees earned overtime and “other”pay equal to 75% to 99% of their salaries, 240 employees received 50% to 75%, 728 employees received 25% to 74% and 889 received up to 24%. Also in the 2012 interview, Danberg said the only way to see significant saving from justice system reform, is if the prison population drops to such an extent that allows one of its facilities to close. Again, further evidence arises when one knows that Delaware’s Justice Reinvestment Initiative Task Force is funded by the U.S. Department of Justice’s Bureau of Justice Assistance through its own Justice Reinvestment Initiative (http://www.vera.org/project/justice-reinvestment-initiative/delaware). Again, this Task Force has requested assistance from the Vera Institute of Justice, which is financially supported by the Open Society Institute (renamed in 2011 to the Open Society Foundations)(http://en.wikipedia.org/wiki/Vera_Institute_of_Justice). The Open Society Institute was founded by billionaire hedge-fund financier, George Soros, in an effort to shape public policy (http://en.wikipedia.org/wiki/Open_Society_Institute).
